Section 88 of CrPc.1973 and 91 of the BNSS-2023 provide the valuable right to the accused to get bail from the trial court if he has not been arrested during the investigation. No need for the apply of the regular bail.

But the same is not available to those accused who are not complying to the summon and bailable warrant issued by the court and if the none-bailable warrant issued by the court for the appearance of the accused.
