Subject : Information as to the commission of the cognizable offence and the registration of FIR u/s  173(1) of BNSS-2023 against the following accused people and the officers of the Koraput SP office.

Sir,

This is to inform you that the above named accused people have committed the crime of cognizable in nature as mentioned below.

  1. That, The informant Mr. Kamal Agarwal, a senior citizen, Human Rights activist & Whistleblower S/o, Late Ram Kumar Agarwal,  & Others O/o. The Advocates Chamber, Sector-6 , Markat Nagar Cuttack – 753014, Odisha is filling this report on behalf of the victims for causing injuries as mentioned below.

  1. 1. That nothing has been done to comply with the rules of law, directions of the competent authority (s), and the guidelines of the apex court by the o/o. the DCP, Bhubaneswar-UPD, and others

    2. That, the PIO did not mention which RTI application he had disposed of. The simple sublet his work to the APIO, who is disposing of the RTI application illegally and arbitrarily, as the APIO has no power, permission, or authority to dispose of an RTI application, thus impersonating the PIO

    3. That, The PIO never provided her name and contact details. The details were never published on the official website, and the RTIOdisha Portal and others kept the domiciles of the state in the darkness, thus making themselves unreachable and unapproachable for the domiciles of the state.

    4. The PIO never provided the name and contact details of the FAA. The PIO and other corrupt officers in office have not allowed any appeal, complaint, etc. to reach the FAA so that the same can be disposed of.

    5. That, The PIO never complied with the direction of the state Govt. issued vide the notification No. 18311 Dt. 22-11-2023.

    6. That, The APIO took the grounds of the judgment of some constitutional court as if his office were the court of law and he is the judge of this court.

    7. That, the order No. 294/DCP-RTI Dt. 05-06-2026 issued, which was received on 06-06-2026, is disposed of after 60 days, i.e., after the mandatory limit of 35 days, which proves that the PIO violated the direction of law.

    8. That, the Senior police officers are not inspecting the office of the PIO as per the Odisha PMR, which caused the police station to become a torture and extortion centre while innocent citizens are getting killed in public places.

    9. That, nothing has been done by the PIO to publicize any information in the RTIOdisha portal, the Koraput District police department has not constituted and launched any official website like PURI and ANGUL. No compliance ever made to the direction of the Govt. issued vide the notification No. 18311 Dt. 22-11-2023, which was issued as per the guidelines of the apex court issued in the case of Kishan Chand Jain Vs UOI, W.P. Civil No. 360 of 2021

    11. That, the above allegations prove that the District Police Department and its officers have no respect for the rule of law, directions of the competent authority(s) and courts, and the guidelines of the apex court, as the Transparency officer is sleeping like KHUMBHAKARNA.

    12. That, the govt. Instrumentalities like the Odisha Information Commission failed miserably to monitor the affairs of the office of the PIO per the provisions of the RTI Act 2005. The Information and Public Relations Department and its officers failed to comply with the rules of law, and the complainant(s) have reason to believe that the same has been done under a deep-rooted criminal conspiracy, intentionally, dishonestly, fraudulently, and for the wrongful gain, and the deceitful means have caused injury to the masses.

    13. That, nothing has been done to comply with the directions of the Orissa High Court issued in the case of Hemanta Nayak Vs State of Odisha w.P. Civil No. 12399 of 2024 and Subhash Behera Vs State of Odisah W.P. Civil No/ 14286 of 2016 thus committed the contempt of the court and the section 10 of the contempt of court act provides for the prosecution of the erring PIO as per the provision of IPC-1860 and BNS-2023.

    14. That, the complainant has reason to believe that one Kalpana Sahoo, the officer of the Commissionerate office, is impersonating as the APIO of the DCP, office Bhubaneswar, and refusing to provide the information sought in RTI applications under a deep-rooted criminal conspiracy, intentionally, dishonestly, fraudulently, and for the wrongful gain and the deceitful means has caused injury to the masses.

    15. The above allegations are only the GIST of the whole affair.

Since the accused people have committed the offence u/s 318(2), 318(3), 318(4), 319(2),198, 198, 201, 204, 336(2), 336(3), 337, 340(2), 111, 61, r/w 3(5) of BNS-2023 So, you are requested to register this FIR taking lawful action against the accuse people as the same is to be investigated by the Crime Investigation Department as per the provision of the section 410-A of the Odisha PMR as the same required special detective skill, the same is an organized crime, matter is considerable public importance, the accused people are police officers.
